Storybutton Inc (“Storybutton”, “we”, "our”, “us”) is a provider of content, screen-free audio devices and applications for children through the Storybutton, allowing children to listen to content spanning all ages and stages. At Storybutton, we believe it is important to be transparent about how we use your personal information.

We recognize the importance of protecting the privacy and security of the personal information we obtain from our customers and consumers. This privacy policy describes how we collect, use, disclose, and protect your personal information.

This privacy policy applies to our U.S. website, storybutton.com, and our App, with the exception of the section titled “California Residents: Your Rights” which applies broadly to all information we collect both online and offline. Our website and App may contain links to third party websites such as Instagram, LinkedIn, or Facebook. Storybutton is not responsible for the privacy policies and practices of those websites. We may revise this privacy policy from time to time. When we make changes to this privacy policy, we will post the updated version on our website and indicate the date it was last updated.

Children Under 13

The Storybutton is designed for all ages and we understand that your child may use the mobile app (“App”) to listen to audio content. However, we have minimized the amount of personal information collected from children under 13 and put you, the parent, in control of that.

We do not ask for personal information from children, and if we determine that a child under 13 has created a Storybutton account, we will immediately cancel that membership and/or close the account. Orders, account creation, and Storybutton club membership are restricted to parents or guardians (“you” or “your”). We put you in control of the personal information we receive about you and your child, and we do not directly collect personal information from children under 13.

Using our Players or App

Data Collection and Usage Policy

Storybutton Inc is committed to collecting minimal data through our devices and apps. When you use Storybutton devices or the Storybutton App, we gather certain usage data, detailed below, to enhance your experience, improve our products, and address any issues (including diagnosing and informing you about any problems with your device).

To ensure privacy, especially for children, the usage data we collect is anonymized and aggregated into analytics data. This data is devoid of personal information and cannot be traced back to any individual child or user.

Usage Data Collection for the Storybutton Device

When you use the Storybutton device, we collect specific usage data to help us improve the device's performance and functionality. This includes:

  • Managing storage and cache.
  • Monitoring audio content, including what is played, when it was played, and the frequency of playback.
  • Tracking system performance metrics, such as remaining memory.

Additionally, we gather error logs and related usage data to diagnose and resolve any technical issues. This data is stored for a reasonable period to facilitate ongoing product improvement. If we identify a potential issue with your device from these logs, we may contact you through email, the Storybutton App, or directly through the device's audio to inform you. In some cases, we may remotely deactivate the device to prevent any issues from escalating. Our legal basis for processing this data is our legitimate interest in ensuring the safety and functionality of our products.

Usage Data Collection for the Storybutton App

The Storybutton App offers a variety of audio content, including free audio, sleep sounds, kid-friendly podcasts, and audiobooks from around the world. It also allows you or your child to record stories and create your own content collections to add onto Storybutton device or share with friends and family.

  • We may send you notifications, including alerts, sounds, and icon badges.
  • The App allows for the creation and uploading of audio content to make collections, which can be added to your Storybutton device. These recordings are stored on our servers, but we cannot access or listen to them. You have the option to delete these collections at any time, or request us to do so. It is your responsibility to review and manage the recordings your child makes and decides to share. Storybutton has no control over the personal information your child may include in these recordings.
  • We collect data on how long you use the App and which version you are running. This information is not linked to your user account.
  • To better understand App usage, we collect data on the audio content played, including playback times and frequency.
  • Error logs and associated usage data are also collected to diagnose and fix any bugs in the App. This data is stored for a reasonable period to assist in product improvement.
Creating a Bttn+ Account

In order to access the App or create a connection between a Storybutton device and the App, you will need to create a Storybutton account. You will need to provide the same email address for your Storybutton account and Shopify account.

We collect: Your email address and a password created by you. After registering, you will receive an email asking you to verify your account. We use security measures to ensure we cannot see the plain text of the password you create. When creating an account, you may provide us with your child’s name to name as one of the Storybutton devices. Storybutton will not, however, ask you for this information. It is your choice to use your child’s name and to provide us with such personal information.

We also wanted to tell you:

  • We are based in the United States, but the providers we use to process your order are based around the world.
  • If you notify us or we otherwise determine that a child under sixteen has been improperly registered for a Storybutton account, we will cancel the child's account and delete the child's personal information from our systems.
Consent to Marketing

We only send marketing communications if you consent to us doing that. You can change your mind at any time by clicking the unsubscribe link in every marketing message we send or by emailing us at privacy@storybutton.com.

Who do we share your personal information with?

Third-Party Data Sharing and Usage

Storybutton Inc does not sell your personal information for monetary consideration. However, certain disclosures we make may be considered a “sale” under the California Consumer Privacy Act (CCPA). For more details, please refer to section 9 below.

We engage third parties to assist in running our business, and we contractually require them to comply with applicable privacy laws. We reserve the right to audit these third parties for compliance. Below, we describe our third-party partnerships:

Website Usage:

  • We work with cookie providers to help us understand how our website is used. These providers are listed in our cookie policy here.
  • We also partner with third parties to host our website, manage our online store, and provide customer service. We only share your personal data with these providers as needed to fulfill your requests, such as processing an online order or responding to a customer service inquiry.

App Usage:

  • We use third parties to support the functionality of our App. Storybutton Inc can see the items you’ve purchased and the content you stream through the App.

Device Usage:

  • We collaborate with third parties to gain insights into how our devices are used and to improve their performance. These partners help us understand the content being played and how the device is functioning. For example, this allows us to ensure frequently played content is stored on your device so you don’t need to download it every time. They also assist us in monitoring, troubleshooting, and notifying you of any product issues with your device.

Regulatory and Legal Obligations:

  • If required, we may disclose your personal data to comply with legal obligations, enforce our terms or other agreements, or protect our business against fraud and credit risks.
  • We may also share personal data with prospective buyers of our business or any part of it to ensure continuity of service.

Business Transactions:

  • In the event of a merger, sale, or acquisition, we may disclose the personal information we maintain.

For brevity and clarity, we have not listed every supplier we work with. Whenever we transfer your personal information outside of the United States, we ensure it receives the necessary protection as required by law. If you have specific questions, please contact us here. We’ll be happy to assist.

Safeguards and retaining your personal information

Security and Data Retention Policy

Storybutton Inc takes reasonable steps to protect the security and confidentiality of your personal information. We strive to safeguard the personal information within our custody or control with appropriate administrative, technological, and physical measures.

For example, we use secure sockets layer (SSL) transmission, which is a protocol for establishing a secure connection for transmitting your personal information. Storybutton Inc also implements other security protocols and measures to protect your personal information from unauthorized access, alteration, and unlawful disclosure. When we dispose of personal information, we take reasonable measures to protect against unauthorized access to the information.

The safety and security of your personal information also depend on you. Where we have given you (or where you have chosen) a password to access certain parts of the website or App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our website or App. Any transmission of personal information is at your own risk. Storybutton Inc is not responsible for circumvention of any privacy settings or security measures contained on the website or App.

Data Retention

Generally, we retain personal information for as long as necessary for the purpose for which it was collected or to comply with applicable legal obligations.

Specifically, we apply the following data retention rules:

  • All user accounts that are inactive (have not been signed into for two (2) years) will be deleted along with their order history, settings, and any other data.
  • All families with no remaining users will be deleted along with their card library, device registrations, and any settings.
  • All orphaned Make Your Own (MYO) content that has not been listened to for over three (3) years may be deleted at any time.
  • We will delete your order information six (6) years after your last order with us.

Before deleting any data, we will reach out to you by email to confirm the deletion and provide instructions on how you can request us not to delete your account information and other personal information.

When we no longer need to retain the information, we will destroy, erase, or de-identify the information. Legal requirements, however, may necessitate retaining some or all of the personal information for a period longer than our standard retention period.

California Residents: Your Rights

California residents (“you” or “your” for purposes of this “California Residents: Your Rights” section) have specific rights regarding your personal information under the California Consumer Privacy Act (“CCPA”). This section supplements the information contained in the other sections of this privacy policy. This section describes your CCPA rights and explains how to exercise them. The CCPA and, as a result, this section of the policy, apply broadly to information collected not only online, but offline as well.

Categories of Personal Information Collected, Disclosed, or Sold in the Last Twelve (12) Months

You have the right to know the categories of personal information Storybutton Inc has collected, disclosed, or sold about consumers within the last twelve (12) months.

Right to Know and Data Portability

You have the right to request that Storybutton Inc disclose certain information to you about our collection, use, disclosure, and sale of your personal information over the past 12 months. Once we receive and confirm your request, to the extent you have requested them, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources from which your personal information was collected.
  • Our business or commercial purpose for collecting your personal information.
  • The categories of third parties with whom we shared your personal information, if any.
  • The specific pieces of personal information we have collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained; and Sales, identifying the personal information categories that each category of recipient purchased.

Right to Delete

You have the right to request that Storybutton Inc delete any of the personal information we have collected and maintain about you, subject to certain exceptions. Once we receive and confirm your request, we will either delete, de-identify, or aggregate your personal information, unless not doing so is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, take actions reasonably anticipated within the context of our business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Your Rights to Know and Delete

To exercise your rights to know and delete under the CCPA, please submit a request by emailing us at privacy@storybutton.com.

Only you, or someone legally authorized to act on your behalf (i.e., your authorized agent), may make a request related to your personal information. Storybutton Inc may require an agent to provide verification that they are acting on your behalf when they submit a request related to your personal information.

All requests to know or delete (whether made by you or an authorized agent) must (1) provide sufficient information for us to reasonably verify you by providing two to three pieces of personal information which we will match with personal information we maintain in our records, and (2) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Right to Opt-Out of Sale

Some of Storybutton Inc’s disclosures of personal information to third parties may constitute a “sale” as that term is defined under the CCPA. However, we do not knowingly collect, disclose, or sell the personal information of children under the age of 16.

If you are age 16 or older, you have the right to direct us not to sell your personal information (known as the "right to opt-out").

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by emailing our marketing and legal team at optout@storybutton.com.

Non-Discrimination & Financial Incentive Notice

Storybutton Inc will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you services;
  • Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of services; or
  • Suggest that you may receive a different price or rate for services or a different level or quality of services.

However, we may offer you certain “financial incentives” permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted “financial incentive” we offer will reasonably relate to your personal information’s value. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time by contacting us at the contact information below. We currently provide the following program which may be considered a “financial incentive” under the CCPA:

Loyalty Program – Storybutton Inc offers a loyalty program where customers can earn points for spending money with us, referring friends, following us on social media, etc. These points can be redeemed for discounts on Storybutton products.

NEVADA RESIDENTS: If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. You can exercise this right by contacting us at privacy@storybutton.com. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A.
